Successful Applications for subclass 485 and 885 on De facto Partner Grounds

Ivy and Matthew were in a loving relationship for many years. Ivy studied life science and Matthew studied accounting for their bachelor degrees. They intended to apply for their PR applications separately and supported each other’s careers. After graduation, Ivy applied for a translation course. Before their student visas were getting expired, they applied for their graduate temporary 485 Visa individually. However, Ivy was unlucky. Both of her majors were not on the skilled occupation list due to migration policy changes, which meant that she could not apply for her PR application based on her own skills. Ivy was so depressed, because if she did not have other choices, she had to leave her beloved Matthew, her job and their sweet home in Sydney and go back to Hong Kong.

Ivy was referred to AUSA Migration when her 485 Visa would expire in one month. After detailed analysis of Ivy’s situation and knowing her boyfriend’s 485 Visa would expired in 4 months, our professional migration agent suggested two options to her. Option one, Ivy’s boyfriend Matthew could apply for his general skilled migration visa  first and when it is granted he could apply for a  spouse visa for Ivy as her sponsor. But in this way, Ivy had to leave Australia temporarily and wait in Hong Kong until their spouse visa was granted and there were many uncertain factors during the long waiting period. Option two, Ivy could apply for general skilled migration with Matthew together as his family member as long as Ivy joined Matthew’s 485 Visa.

In our submission, we applied forIvy to join Matthew’s 485 visa first. With 10 weeks’ queue, Ivy got her case officer allocated and luckily her HK police check previously used for her own 485 visa application was accepted. She got her visa granted immediately.

The timing was good. Ivy and Mathew then could lodge their application for an 885 visa before Mathew’s 485 visa expired. Matthew and Ivy got their PR granted in just 5 months.  Ivy is now studying  medic course and she will become an excellent doctor in the near future.
